Terms of Service
The agreement governing access to Harbor websites, apps, APIs, and related offerings.
These Terms of Service ("Terms") govern access to and use of Harbor ("Harbor", "we", "us") websites, applications, APIs, documentation, and related offerings (collectively, the "Services").
By accessing or using the Services, creating an account, or submitting a form, you agree to these Terms and our Website Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility and authority
You must be at least 18 years old to use the Services. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" includes that organisation.
Additional program-specific terms (including Contributor Terms and enterprise order forms) may apply and control where they conflict with these general Terms for that program.
2. The Services
Harbor provides commercial egocentric data infrastructure and related offerings, which may include:
- Marketing sites, research publications, and product documentation
- Contributor and expert programs for capture, annotation, validation, and evaluation
- Enterprise collection, QA, packaging, delivery, and program management tools
- APIs, dashboards, authentication, and support surfaces
We may modify, suspend, or discontinue features with reasonable notice where practicable. We do not guarantee uninterrupted or error-free operation.
3. Accounts
- Provide accurate, current, and complete registration information
- Keep credentials confidential and notify us promptly of unauthorised use
- You are responsible for activity under your account
We may suspend or terminate accounts that violate these Terms, create security or fraud risk, or remain inactive for extended periods.
4. Acceptable use
You must not:
- Violate applicable law, regulation, or third-party rights
- Submit false, misleading, infringing, or unlawful content
- Attempt to bypass security, scrape beyond permitted use, or reverse engineer the Services
- Interfere with or disrupt the Services or other users
- Use the Services to develop or distribute harmful, discriminatory, or unlawful applications
- Resell, sublicense, or redistribute Harbor materials without written permission
- Misrepresent affiliation with Harbor or our clients
5. Intellectual property
5.1 Harbor materials
Harbor and its licensors retain all rights in the Services, software, branding, documentation, research publications, and underlying technology. These Terms do not transfer ownership of Harbor IP to you.
5.2 Your content
You retain ownership of content you submit, subject to the licenses needed for Harbor to operate the Services and deliver agreed outcomes. For contributor work product, see the Contributor Terms.
5.3 Feedback
If you provide feedback or suggestions, you grant Harbor a perpetual, irrevocable, royalty-free license to use that feedback without restriction or attribution.
6. Enterprise customers
Enterprise use may be governed by separate order forms, master services agreements, statements of work, or data processing agreements. Those documents control for the scoped engagement. Dataset and deliverable licenses are defined in the applicable project terms.
7. Fees
Paid Services are described at checkout, in an order form, or in writing. You authorise Harbor to charge applicable fees using your selected payment method. Fees are generally non-refundable except where required by law or expressly agreed in writing.
8. Privacy
Personal information is handled as described in our Website Privacy Policy, Cookie Policy, and where applicable the Contributor Privacy Notice. You are responsible for complying with privacy laws when you provide data about others.
9. Confidentiality
Each party will protect the other's non-public information and use it only as needed to perform under these Terms or as required by law. Client briefs, program materials, pricing, and non-public platform features may be confidential.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. DATASETS, EVALUATIONS, AND WORK PRODUCT MAY CONTAIN ERRORS, GAPS, OR BIAS.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARBOR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE.
OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO HARBOR FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED POUNDS STERLING (£100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
12. Indemnification
You agree to indemnify and hold harmless Harbor from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your breach of these Terms.
13. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or if continued access creates legal, security, or operational risk. Sections that by nature should survive (including IP, confidentiality, disclaimers, liability limits, and indemnities) survive termination.
14. Changes
We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes take effect constitutes acceptance where permitted by law.
15. Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction.
16. General
- Entire agreement — These Terms and the referenced policies form the core agreement unless a signed enterprise agreement applies
- Severability — If any provision is unenforceable, the remainder stays in effect
- Assignment — You may not assign these Terms without our consent; we may assign them in connection with a reorganisation or sale
- Force majeure — Neither party is liable for delays caused by events beyond reasonable control
- No waiver — Failure to enforce a provision is not a waiver of that provision
