Harbor ML is operated by COLOR HOUSE LTD (registered company).

These Terms of Service ("Terms") govern your access to and use of Harbor ML ("Harbor") websites, mobile applications, APIs, contributor programs, expert recruitment tools, and related offerings (collectively, the "Services"). The Services are provided by COLOR HOUSE LTD ("we", "us").
By creating an account, applying to a program, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Acceptance of terms
If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. Additional program-specific agreements may apply and will control where they conflict with these general Terms.
2. Description of services
Harbor provides, among other things:
- Contributor and expert programs for data capture, annotation, and domain review
- Recruitment and vetting workflows, including AI-assisted voice interviews
- Enterprise data collection, QA, packaging, and delivery tools
- APIs, dashboards, and documentation for clients and partners
Features may change over time. We may add, modify, or discontinue parts of the Services with reasonable notice where practicable.
3. Account registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Keep your credentials secure and notify us of unauthorised access
- Accept responsibility for activity under your account
We may suspend or terminate accounts that violate these Terms or pose a security or fraud risk.
4. License and acceptable use
4.1 Platform license
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose.
4.2 Permitted use
You may use the Services to participate in Harbor programs, deliver work product, and collaborate with our team or clients as authorised.
4.3 Prohibited use
You must not:
- Violate applicable law or third-party rights
- Submit false, misleading, or infringing content
- Attempt to bypass security, scrape beyond permitted limits, or reverse engineer the Services
- Use the Services to harm individuals, discriminate unlawfully, or develop harmful applications
- Resell, sublicense, or redistribute Harbor materials without written permission
5. Contributor and expert programs
If you participate as a contributor or expert:
- You are an independent contractor, not an employee, agent, or partner of Harbor
- You represent that you have the right to submit all work product you provide
- You grant Harbor and authorised clients the rights needed to use submissions for agreed program purposes
- Compensation, quality standards, and eligibility are defined by each program and may change
- We may reject, reassign, or request revision of work that does not meet requirements
6. Client and enterprise use
Enterprise customers may be subject to separate order forms, statements of work, or data processing agreements. Dataset and deliverable licenses are governed by the terms attached to each project or dataset.
7. Fees and payment
Paid Services, subscriptions, or usage-based fees are described at checkout, in an order form, or on our pricing pages. You authorise us to charge applicable fees using your selected payment method. Fees are generally non-refundable except where required by law or expressly stated in writing.
8. Intellectual property
8.1 Harbor property
Harbor retains all rights in the Services, software, branding, documentation, and underlying technology. These Terms do not transfer ownership of Harbor intellectual property to you.
8.2 Your content
You retain ownership of content you submit, subject to the licenses you grant Harbor to operate the Services and deliver agreed program outcomes.
8.3 Work product and models
Ownership of annotations, datasets, evaluations, or model outputs depends on the applicable program or client agreement. Where no separate agreement exists, Harbor may use submissions to operate, improve, and deliver the Services.
9. Privacy and data protection
Our collection and use of personal information is described in our Privacy Policy. You are responsible for ensuring your use of the Services complies with applicable data protection laws and for obtaining necessary consents from individuals whose data you provide.
10. Confidentiality
Each party will protect the other's confidential information and use it only as needed to perform under these Terms or as required by law. Program materials, client briefs, and non-public platform features may be confidential.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION. DATASETS AND WORK PRODUCT MAY CONTAIN ERRORS OR BIAS.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLOR HOUSE LTD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL.
OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO HARBOR IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED POUNDS STERLING (£100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
13. Indemnification
You agree to indemnify and hold harmless Harbor from claims, losses, and expenses arising from your use of the Services, your submissions, or your breach of these Terms.
14. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or if continued access poses legal, security, or operational risk. Provisions that by nature should survive termination will survive, including intellectual property, confidentiality, disclaimers, liability limits, and indemnities.
15. Changes to these terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use after changes take effect constitutes acceptance.
16. Governing law and disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction.
17. General
- Entire agreement: These Terms and the Privacy Policy form the core agreement between you and Harbor unless a separate signed agreement applies
- Severability: If any provision is unenforceable, the remainder stays in effect
- Assignment: You may not assign these Terms without our consent. We may assign them in connection with a reorganisation or sale
- Force majeure: Neither party is liable for delay caused by events beyond reasonable control
